As the licensing of Intellectual Property (IP) rights grows in significance within the global economy, the treatment of these agreements during insolvency has garnered international attention. This presentation delves into the complexities and consequences of how different countries handle IP licenses in cross-border insolvency proceedings, particularly in the absence of international harmonization. This divergence, driven by conflicting policy objectives of insolvency and IP law, poses significant risks to stakeholders and global innovation.
This presentation will engage with the central question: Why and how should the legal uncertainty surrounding IP licenses in cross-border insolvencies be addressed?
By shedding light on the complexities of this issue and proposing actionable recommendations, this study seeks to foster a more conducive environment for innovation and economic growth on a global scale.
The speaker of the seminar is the doctoral student of the European University Institute, Guillem Gabriel Pizarro. The panelists are Francisco J. Garcimartín Alférez (Prof. Catedrático, Universidad Autónoma de Madrid) and Ángel Espiniella Menéndez (Prof. Catedrático, Universidad de Oviedo).
